1.0 Acceptance of Terms
By engaging our services or purchasing our goods, you agree to be bound by these terms and conditions (the “Terms”). These Terms apply to all services provided and goods sold by the Supplier to the Client.
2.0 Price
The following rates shall apply when work is charged on a time and materials (charge-up) basis, and for calculating any variations to quoted work. Labour is charged from our workshop to your job site and back, including any time spent acquiring materials for your job from merchant suppliers.
Prices quoted exclude GST:
- Labour Builder: $90 per hour.
- Apprentices/Labourers: From $65 per hour, depending on experience.
- Materials: Recommended Retail Price.
- Vehicle Charges: $60 per visit.
When a quotation has been provided for work to be performed, that quotation remains valid for 30 working days. Your acceptance of our quotation/offer must be confirmed either in writing or by clicking the ‘Accept Quote’ button in our email, prior to the commencement of work. We reserve the right to withdraw the quotation at any time before it is accepted.
The quotation is based on costs and charges in effect at the date of the quotation. Any changes in costs arising from factors beyond our control (for example, changes in prices charged by our suppliers or changes in government charges) will be added to your account.
3.0 Payment
The claimed amount is due and payable by you within 5 working days after you receive our invoice. Overdue amounts will be referred to our Collection Agency, and all fees incurred in recovering the debt will be borne by the purchaser/client.
4.0 Disputes
Should any dispute or difference arise in connection with the work performed or payments claimed by us, or any other matter pertaining to business between us and you, either party shall refer the dispute to adjudication under Part 3 of the Construction Contracts Act 2002 (CCA).
5.0 Ownership
Goods and materials supplied by us remain our property until fully paid for. If any amount remains unpaid or you breach any obligation to us, we or our agents are authorized by you to enter your premises to recover and resell any of those goods and materials. We may require you to assist in registering a Financing Statement under the Personal Property Securities Act 1999 to secure a Perfected Security Interest in any goods supplied.
6.0 Risk
Once goods and materials are on your premises or premises under your control, they are at your risk. You shall bear any loss arising from theft, destruction, or damage from any cause.
7.0 Consents
You are responsible for obtaining any necessary consents or other authorities for the work and must provide them to us upon request. If a building consent is required and you have not obtained it, we may lodge a building consent application on your behalf and at your expense.
8.0 Warranty
Our commitment to quality is backed by our 12-Month Defect Repair Period and 10-Year Structural Guarantee, ensuring that your investment is protected for years to come. For more details, please refer to the warranty information on our website.
If you supply the materials/fittings and they fail, any work by Level Headed Construction to rectify the situation will be chargeable. This performance guarantee does not extend to any goods or materials supplied by you. For work covered by the Consumer Guarantees Act 1993, this warranty complements any rights you may have under the Act.
9.0 Privacy Act 2020
You authorize us to collect, use, and disclose personal information as necessary for purposes related to performance under this agreement, in compliance with the Privacy Act 2020. We are committed to safeguarding your personal information and will take all reasonable steps to ensure its security. We will never sell your information. In the event of a “serious” data breach, we will report it immediately if there is a “risk of harm” as mandated by the updated legislation.
10.0 Estimates
An estimate is not a fixed price. It is an approximate indication of expected cost and may vary by up to 25% from the original figure given.
11.0 Quotes (and Estimates)
Level Headed Construction provides free quotes. A quote is given when you know exactly what work you want done, typically accompanied by a plan and/or specification. If the desired outcome is known but the necessary work is not, investigation and advice on our part may be required, which will incur a charge.
For larger projects requiring extensive quoting, a fee may be applicable to cover the detailed assessment and planning involved.
12.0 Investigation Work
Time spent by Level Headed Construction investigating an issue to determine its cause or location is chargeable at our standard hourly rate, regardless of whether further work is performed.
13.0 Collecting Materials
Time spent by our tradesmen collecting parts or materials from a merchant supplier, either before arriving at your property or when leaving your property to collect parts/materials for your job, is chargeable to you.
14.0 Health & Safety
Health & Safety for our staff, clients, and the general public is paramount. Some tasks, such as roof work, may require two people to ensure everyone’s safety. Our tradesmen reserve the right to reject or defer a job if conditions are deemed unsafe, such as high winds or rain during roof work. Legal Health & Safety requirements for roof work may increase the cost of the work.

15.0 Timber
Timber naturally expands and contracts. We cannot be held liable for such natural occurrences.
16.0 Website Security and Confidentiality
At Level Headed Construction, we prioritise the confidentiality of all documents and information gathered, whether electronic or otherwise, and adhere to the highest professional standards. Our website employs industry-standard security measures to prevent unauthorised access, disclosure, or alteration of your personal information. While we are committed to providing the highest level of security, we recognise that no technique of internet transmission or computer storage is perfect.
